Chapter One: General Principles
1. Purpose of the System
This system aims to protect the interests and rights of all parties dealing through the platform
by establishing a comprehensive legal and regulatory framework that ensures transparency,
fairness, and proper execution throughout all stages of contracting.
2. Nature of the Platform’s Operation
The platform operates as an independent and neutral electronic intermediary, enabling clients
and service providers to conclude digital agreements and select employees, without the platform
being a direct party to the contractual relationship between the client and the service provider
or between the client and the selected employee.
3. Scope of Application
These provisions apply to all works and services executed through the platform, whether between
parties located inside the State of Qatar or outside it.
Chapter Two: Definitions
- Platform: The entity operating the application or website connecting clients with service providers, employees, or CV owners, owned by Al Sharq for Technical Solutions W.L.L.
- Client: Any natural or legal person using the platform to request a service.
- Service Provider: Any natural or legal person providing services through the platform for remuneration.
- Order: The electronic agreement concluded through the platform.
- Arbitration: A specialized internal committee that resolves disputes and issues binding decisions.
- Deliverables: The final agreed outcome of the service.
- Commission: The percentage deducted by the platform for mediation or transfer services.
- Subscription: Access to the CV database for a defined period.
- Employee: An individual selected to work remotely or on-site.
- Technical Service: Includes development, applications, websites, maintenance, and IT services.
- Outsourcing: Employee provision managed by the client or the platform.
- CV Owner: A person providing their CV for recruitment purposes.
Chapter Three: Technical Service Requests
1. Financial Guarantee & Funds Protection
- Client funds are held in a separate account upon contract conclusion.
- Funds are released only after approval or expiration of the 10-day review period.
- Cash or off-platform transfers are strictly prohibited.
- All payments are processed through an approved secure financial system.
- Amounts are frozen during disputes until arbitration resolution.
- The platform may withhold funds in cases of suspected fraud.
2. Service Provider Obligations
- Execute services according to agreed specifications and timeline.
- No modification or cancellation after agreement completion.
- Submit deliverables only through the platform.
- No plagiarized or unlicensed content.
- Maintain confidentiality and client privacy.
- No off-platform communication.
- Accept commission and transfer fee deductions.
3. Client Obligations
- Provide clear and accurate requirements.
- Deposit payments through the platform before execution.
- Review deliverables within 10 days.
- Cooperate in disputes and provide evidence.
- Avoid false reports or abusive ratings.
4. Execution, Delivery & Approval Stages
- Stage One: Request & Offer
- Stage Two: Contracting & Execution
- Stage Three: Delivery & Review
- Stage Four: Approval & Payment Transfer
5. Cancellation & Refund
- Before execution: Full refund minus transfer fees.
- During execution: Compensation based on completion level.
- Proven breach by service provider: Full refund minus fees.
- Milestone-based work is subject to phase approval.
- No refunds after final approval.
6. Arbitration & Dispute Resolution
- Disputes are submitted through the platform.
- Reviewed by technical and legal experts.
- Decisions issued within 15 days.
- Decisions are final and binding.
- Accounts may be suspended for violations.
Chapter Four: Outsourcing Service Requests
Remote Work – Client Management: Platform bears no liability.
Remote Work – Platform Management: Platform acts as employer.
On-site Work: Employee legally affiliated with the platform.
Chapter Five: CV Subscription Service
Subscriptions allow viewing only. Fees are non-refundable. Data use is restricted to recruitment.
Chapter Six: Intellectual Property Protection
- Ownership transfers after full payment.
- Reuse or resale is prohibited.
- Infringing content may be removed.
Chapter Seven: Loss of Guarantee Rights
- Off-platform contracting.
- Expired review period.
- Fraud or breach.
- Failure to cooperate.
- Violation of platform terms.
Chapter Eight: Final Provisions
- Platform is not responsible for off-platform agreements.
- Terms may be amended at any time.
- Governed by the laws of the State of Qatar.
- Use of the platform constitutes acceptance.
Financial & Payment Procedures
Collection and disbursement policies are developed in coordination with the finance department,
defining approval controls, accounting procedures, execution mechanisms, and timelines for
deposits, withdrawals, payments, and refunds to ensure transparency.
